Medtronic Settles Kyphon Suit for $75M

Medtronic reached a $75 million settlement with the Department of Justice, to settle claims that Kyphon Inc., which the company recently purchased, caused hospitals to submit inflated claims for treatment associated with a back surgery procedure known as kyphoplasty treatment.

Medtronic acquired Kyphon in November 2007 for $3.9 billion, after the allegations were made.

Medtronic said the settlement agreement reflects its assertion that Kyphon did not engage in any wrongdoing or illegal activity, and it will sign an agreement with the Office of Inspector General for the Department of Health and Human Services, an agency that works to educate companies about giving appropriate reimbursement advice to customers.
